About these terms
These Terms of Use apply to access to and use of the IMS Promotions platform. IMS Promotions provides tools for configuring and operating customer engagement campaigns across different clients and brands.
Accessing or using the platform is subject to these terms together with any applicable contractual, organisational or access arrangements governing the relevant user or client.
These Terms of Use govern the IMS Promotions platform. Individual campaigns may have separate participation terms, eligibility requirements, privacy notices and other campaign-specific conditions.
The IMS Promotions platform
IMS Promotions is designed to support campaign administration, configurable customer journeys, messaging interactions, campaign verification integrations and related operational activities.
Platform functionality may vary according to the configuration, integrations and services enabled for a particular client, brand or campaign.
Authorised access
Administrative areas of IMS Promotions are intended for authorised users. Users are responsible for using their access only for legitimate business purposes associated with their authorised role.
Users must take reasonable steps to protect authentication credentials and must not knowingly allow another person to use an account or access mechanism assigned specifically to them, except where an authorised access arrangement expressly permits it.
Suspected unauthorised access, compromised credentials or other security concerns should be reported through the appropriate organisational support or security channel.
Acceptable use
Users must use IMS Promotions responsibly and in accordance with applicable law, authorised business purposes and relevant platform or communication-channel requirements.
Users must not intentionally:
- attempt to gain access to accounts, campaigns, systems or information for which they are not authorised;
- interfere with the operation, security or availability of the platform;
- introduce malicious software, harmful code or other destructive material;
- use the platform to send communications that are unlawful or inconsistent with applicable messaging requirements;
- misuse customer information or campaign data obtained through the platform; or
- attempt to circumvent platform controls or security mechanisms.
Campaign responsibilities
IMS Promotions is a configurable multi-brand platform. The organisation responsible for a campaign remains responsible for ensuring that its campaign configuration, content, eligibility requirements, customer communications, participation terms, privacy notices and consent requirements are appropriate for that campaign.
Campaign administrators should review configured customer journeys and content before publication and should ensure that campaign-specific information remains accurate while the campaign is active.
Third-party services and integrations
IMS Promotions may connect with third-party services used for messaging, infrastructure, campaign verification or other configured functions.
Third-party services are subject to their own availability, terms, technical requirements and policies. Use of IMS Promotions does not replace or override requirements imposed by those third parties.
Changes made by a third-party provider may affect an integration or functionality that depends on that provider.
Campaign content and configuration
Authorised users may configure campaign content, conversational flows, templates, media, options, verification behaviour and other supported campaign settings.
Users responsible for such configuration should ensure that content is accurate, authorised and appropriate for its intended audience and communication channel.
Publication or activation of a campaign configuration does not by itself constitute legal, regulatory or policy approval of the underlying campaign or its content.
Platform availability and changes
IMS Promotions may be updated, maintained or modified as the platform evolves. Features may change as technical, operational, security or integration requirements develop.
Although reasonable efforts may be made to maintain reliable service, uninterrupted or error-free availability cannot be guaranteed. Availability may also be affected by networks, infrastructure and third-party services outside the direct control of the platform.
Security
Users must not take actions that compromise or attempt to compromise the security of IMS Promotions, connected systems, campaign information or customer information.
Access may be restricted where reasonably necessary to protect the platform, investigate suspected misuse, respond to a security issue or protect connected services and information.
Intellectual property
Rights in IMS Promotions, including its platform software, design and associated proprietary materials, remain with their respective owner or authorised rights holder.
Campaign-specific names, logos, media, trademarks and other materials may belong to clients, brands or other third parties. Use of such material within the platform does not transfer ownership of those rights.
Privacy and data
Use of IMS Promotions may involve processing personal information relating to administrative users, campaign participants and customer interactions.
Further information about platform-level privacy practices is provided in the IMS Promotions Privacy Policy. Individual campaigns may also provide separate privacy notices applicable to campaign participants.
Read the IMS Promotions Privacy PolicySuspension and termination
Access to IMS Promotions may be restricted, suspended or withdrawn where access is no longer authorised or where doing so is reasonably necessary for security, operational, contractual or compliance reasons.
Organisational or contractual arrangements applicable to a client or authorised user may contain additional provisions concerning platform access and termination.
Responsibility and liability
Responsibility for IMS Promotions and its use may also be governed by applicable client agreements and other contractual arrangements. Nothing on this public page is intended to replace terms agreed in an applicable written agreement.
To the extent permitted by applicable law, responsibility for third-party services, campaign-specific content and matters controlled by external providers remains subject to the arrangements applicable to those services and parties.
Changes to these terms
These Terms of Use may be updated to reflect changes to IMS Promotions, applicable requirements or platform practices. The date displayed at the top of this page identifies the current version.
